Terms of Service

Please read these Terms of Service ("Terms") carefully before using Varimuse ("we," "us," or "our") at varimuse.ai (the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Description of Service

Varimuse is an AI-powered creative platform that enables users to generate, compare, and curate variations of AI-generated content. The Service allows you to:

  • Submit prompts to generate AI-created images and other content
  • Compare multiple variations across configurable dimensions
  • Save favorite outputs as "Picks" and organize them into collections
  • Publish selected content to a public gallery for community viewing
  • Vote on and discover content shared by other users

2. Eligibility and Account Registration

2.1 Age Requirement

You must be at least 13 years old (or 16 in certain jurisdictions) to use the Service. By using the Service, you represent that you meet this age requirement. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2.2 Account Creation

To access certain features, you must create an account by providing a valid email address. We use passwordless authentication via "magic links" sent to your email. You are responsible for:

  • Maintaining the security of your email account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information is accurate and current

2.3 Account Restrictions

You may not:

  • Create multiple accounts to circumvent restrictions or bans
  • Share your account access with others
  • Transfer or sell your account
  • Use automated means to create accounts

3. Credits and Payment

3.1 Credit System

The Service operates on a credit-based system. Credits are used to generate content through our AI providers. New accounts receive a limited number of complimentary credits. Additional credits can be purchased through our platform.

3.2 Credit Pricing

Credit packages are priced at approximately $1 USD per 1,000 credits, with bonus credits available on larger packages. The exact cost per generation varies based on the AI model used and generation parameters. Current pricing is displayed on our pricing page and at the time of purchase.

3.3 Credit Expiration

Credits do not expire as long as your account remains active and in good standing. However, credits may be forfeited if your account is terminated for violation of these Terms.

3.4 Refund Policy

All credit purchases are final and non-refundable, except:

  • Where required by applicable consumer protection laws
  • Where credits were charged but the Service completely failed to deliver any functionality (not applicable to individual failed generations)
  • In cases of duplicate charges or billing errors, which will be corrected upon verification

Credits are not refunded for: failed generations (which may occur due to AI provider issues, content filtering, or technical limitations), unused credits, account termination for Terms violations, or dissatisfaction with generated outputs.

3.5 Failed Generations

Generations may occasionally fail due to AI provider errors, content policy violations, or technical issues. In most cases of technical failures (not content policy violations), credits are not deducted or may be refunded automatically. We do not guarantee that every generation attempt will succeed.

3.6 Price Changes

We reserve the right to modify credit pricing at any time. Price changes will not affect credits already purchased. We will provide reasonable notice of significant price increases.

4. User Content and Intellectual Property

4.1 Your Prompts

You retain ownership of the original creative expression in the prompts you submit ("User Prompts"). By submitting prompts, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and transmit your prompts as necessary to provide the Service, including transmitting them to third-party AI providers.

4.2 Generated Content Ownership

The ownership of AI-generated content ("Generated Content") is a complex and evolving legal area. Subject to the terms of the underlying AI models and applicable law:

  • Your Rights: To the maximum extent permitted by law and the applicable AI provider terms, you may use Generated Content created from your prompts for personal and commercial purposes, subject to Section 4.3.
  • No Exclusivity: AI models may generate similar or identical outputs for different users with similar prompts. We cannot guarantee that your Generated Content is unique or that others will not create substantially similar content.
  • Third-Party Terms: Your rights to Generated Content may be subject to additional restrictions imposed by the AI model providers (such as Replicate, Stability AI, OpenAI, etc.). It is your responsibility to review and comply with applicable provider terms.

4.3 License to Varimuse

By using the Service, you grant Varimuse a non-exclusive, worldwide, royalty-free license to:

  • Store, display, and deliver your Generated Content through the Service
  • Create thumbnails and previews of your content
  • Display published content in our Explore gallery
  • Use your content for Service improvement and promotional purposes (for published content only)

For unpublished content, this license is limited to what is necessary to provide the Service to you. You can delete your content at any time, which will terminate this license (subject to technical delays for backups).

4.4 Varimuse Intellectual Property

The Service, including its design, features, code, documentation, trademarks, and branding, is owned by Varimuse and protected by intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or branding without express permission.

5. Acceptable Use Policy

5.1 Prohibited Content

You agree not to use the Service to create, upload, or distribute content that:

  • Sexually Explicit Material: Pornographic, sexually explicit, or NSFW content, including nude imagery or sexual acts. Our Service employs automated content filtering that will block such content.
  • Child Sexual Abuse Material (CSAM): Any content depicting minors in sexual situations. This is strictly prohibited and will result in immediate account termination and reporting to appropriate authorities.
  • Violence and Gore: Extreme violence, graphic gore, or content glorifying violence against individuals or groups.
  • Hate Speech: Content that promotes hatred, discrimination, or violence based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
  • Harassment: Content intended to harass, bully, threaten, or intimidate specific individuals.
  • Deceptive Content: Deepfakes, synthetic media, or AI-generated content intended to deceive others about real events or real people without their consent, particularly for fraud, defamation, or political manipulation.
  • Illegal Activities: Content that promotes or facilitates illegal activities, including drug trafficking, fraud, or terrorism.
  • Intellectual Property Infringement: Content that infringes on copyrights, trademarks, or other intellectual property rights of third parties, including unauthorized reproductions of copyrighted characters or artwork.
  • Privacy Violations: Content containing personal information of others without their consent, or realistic likenesses of real individuals without authorization.

5.2 Prohibited Conduct

You agree not to:

  • Attempt to circumvent content filters, rate limits, or security measures
  • Use automated tools, bots, or scripts to access the Service without authorization
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Interfere with or disrupt the Service or servers
  • Impersonate others or misrepresent your affiliation with any person or entity
  • Use the Service to send spam or unsolicited communications
  • Resell access to the Service or Generated Content as a competing service
  • Access the Service from jurisdictions where such access is prohibited

5.3 Content Moderation

We employ automated systems and may conduct manual reviews to detect and prevent prohibited content. We reserve the right to:

  • Block or filter content that violates our policies
  • Remove content without notice
  • Suspend or terminate accounts for violations
  • Report illegal content to appropriate authorities

Users may report content that violates these Terms through our reporting feature. Repeated violations of content policies may result in permanent account termination.

6. Published Content and Community Features

6.1 Publishing to Explore

You may publish your Picks and collections to our public Explore gallery. By publishing:

  • You represent that the content complies with these Terms
  • You grant other users the right to view and vote on your content
  • You understand the content will be publicly visible and indexed by search engines
  • You may unpublish content at any time

6.2 Voting and Credits

The Explore gallery includes a voting system where users can vote for content they appreciate. Voting may involve credit transfers between users. The specific mechanics of vote costs and rewards are displayed in the Service and may be adjusted over time.

6.3 No Endorsement

The presence of user content in the Explore gallery does not constitute endorsement by Varimuse. We do not verify the accuracy, quality, or legality of user-published content.

7. Third-Party Services and AI Providers

7.1 AI Model Providers

The Service relies on third-party AI model providers to generate content. These providers have their own terms of service and acceptable use policies that may impose additional restrictions on your use of Generated Content. Key providers may include:

  • Replicate
  • Stability AI
  • OpenAI
  • Other model providers as we expand our offerings

We do not control these providers and are not responsible for their performance, downtime, or changes to their services that may affect the Service.

7.2 Third-Party Links

The Service may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of any third-party sites.

8. Disclaimers and Limitation of Liability

8.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Generated Content will meet your expectations or requirements
  • Generated Content will be unique, original, or non-infringing
  • AI models will always produce accurate, appropriate, or useful outputs
  • The Service will be compatible with all devices or browsers

8.2 AI-Generated Content Disclaimer

AI-generated content is inherently unpredictable. Models may produce outputs that are inaccurate, nonsensical, biased, offensive, or otherwise unsuitable despite appropriate prompts. We are not responsible for the content of AI-generated outputs.

You acknowledge that AI-generated content may inadvertently resemble existing copyrighted works, trademarks, or real individuals. You are solely responsible for reviewing Generated Content before any use, particularly commercial use, and for ensuring it does not infringe third-party rights.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VARIMUSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or content
  • Cost of substitute services
  • Damages arising from your use or inability to use the Service
  • Damages arising from Generated Content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO VARIMUSE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8.4 Indemnification

You agree to indemnify, defend, and hold harmless Varimuse and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your User Prompts or Generated Content
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any claim that your content caused damage to a third party

9. Account Suspension and Termination

9.1 Termination by You

You may terminate your account at any time by contacting us at [email protected] or through account settings. Upon termination:

  • Your access to the Service will end
  • Your Generated Content will be deleted (except published content, which will be unpublished first)
  • Any unused credits will be forfeited
  • We may retain certain data as described in our Privacy Policy

9.2 Termination or Suspension by Us

We may suspend or terminate your account immediately, without notice, if:

  • You violate these Terms or our Acceptable Use Policy
  • Your account is used for illegal activities
  • You engage in fraudulent or deceptive conduct
  • We are required to do so by law
  • We discontinue the Service (with reasonable notice)

9.3 Effect of Termination

Upon termination for cause, you forfeit all unused credits and may not create a new account without our express permission. Sections 4 (Intellectual Property), 5 (Acceptable Use), 8 (Disclaimers and Liability), 10 (Governing Law), and 11 (Dispute Resolution) survive termination.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

11. Dispute Resolution

11.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. Most disputes can be resolved this way.

11.2 Binding Arbitration

If we cannot resolve a dispute informally within 30 days, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in English, and the arbitrator's decision shall be binding and final.

11.3 Class Action Waiver

YOU AND VARIMUSE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

11.5 Opt-Out

You may opt out of the arbitration and class action waiver provisions by sending written notice to [email protected] within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we will provide additional notice via email or through the Service.

Your continued use of the Service after the effective date of revised Terms constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Service and may terminate your account.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Varimuse regarding the Service and supersede all prior agreements.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

13.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or failures of third-party services.

13.6 Notices

We may provide notices to you via email to the address associated with your account, or through the Service. You may provide notices to us at [email protected]. Notices are effective upon receipt.
